In a decisive judgment that has reverberated through Nigeria’s political scene, the Federal High Court in Port Harcourt has nullified the appointment of a Sole Administrator to govern Rivers State, siding firmly with Governor Siminalayi Fubara of the Peoples Democratic Party (PDP).

Delivered on Tuesday morning, the court’s ruling mandates the immediate eviction of the Tinubu-appointed Sole Administrator from the Government House within 48 hours. The decision reaffirms Governor Fubara’s position as the constitutionally recognized and democratically elected leader of Rivers State.

The verdict comes after months of growing political turmoil in the state, largely fueled by a bitter fallout between Governor Fubara and his former mentor, ex-governor and current Minister of the Federal Capital Territory (FCT), Nyesom Wike. Tensions escalated further when President Bola Ahmed Tinubu controversially installed a Sole Administrator to oversee state affairs — a move widely condemned by legal experts and civil society as undemocratic and unconstitutional.

Presiding over the case, Justice Boma Diepriye firmly declared that the appointment of a Sole Administrator in a state governed by an elected and active governor is "illegal, null, and void." The court emphasized that the 1999 Constitution of the Federal Republic of Nigeria does not provide for such an arrangement unless the sitting governor is removed through impeachment or found to be medically or otherwise incapacitated.
